1. 🤝 Acceptance of Terms and Conditions 

PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY.

These Terms and Conditions (“T&C”) govern your use of the Print Afrika website (the “Site”) and the purchase of any products or services offered herein. By using the Site, you indicate your acceptance of these T&C. If you do not accept these T&C, please refrain from using this Site.

The Site is owned and operated by ColourBeat Afrika Holdings, which reserves the right to change the nature of this relationship at any time and to revise these T&Cs from time to time. Users who violate these T&C may have their access to the Site suspended or permanently banned. Users should check these T&Cs periodically. By using the Site after we post changes to these T&C, you agree to accept those changes.

  • “Customer” or “you” means the person or company who places an order via the Site to purchase any of the Products.

  • “Products” means the printing, branding, apparel, and corporate gift products offered for sale by Print Afrika via the Site.

Cookies are small encrypted data files that may be stored on your hard drive once you have accessed the Site. Print Afrika uses cookies to enhance your shopping experience, track your shopping cart, and maintain user-specific preferences. This site is controlled and operated by ColourBeat Afrika Holdings. All material on this Site, including images, illustrations, audio clips, and video clips, is protected by copyrights, trademarks, and other intellectual property rights owned or controlled by us or licensed to us.

  • The Print Afrika logo, name, and design are ALL RIGHTS RESERVED.

  • All other trademarks, product names, and company names or logos cited herein are the property of their respective owners.

  • You may not reproduce, create derivative works from, republish, upload, transmit, or distribute any materials from the site without Print Afrika’s prior written permission.

  • Printing materials for the sole intent of placing an order is permitted. Any other printing, modification, distribution, or republication of materials without our prior written permission is strictly prohibited and constitutes an infringement of proprietary rights.

4. 👤 Account and Registration Obligations 

“Your Information” is defined as any information you provide to us during the registration, buying, or listing process. We will protect your information in accordance with our privacy policy.

4.1. Account Security 

If you use the Site, you are responsible for:

  • Maintaining the confidentiality of your account and password.

  • Restricting access to your computer.

  • Accepting responsibility for all activities that occur under your account or password.

Print Afrika is not liable for any loss or damage that may arise as a result of your failure to protect your password or account. If you suspect your password has been compromised, you must notify us immediately via the contact information on our Contact Us page.

4.2. Registration Data 

You agree to:

  • Provide true, accurate, current, and complete information about yourself (“Registration Data”) as prompted by the registration form.

  • Maintain and promptly update the registration data to keep it true, accurate, and complete.

If Print Afrika has reasonable grounds to suspect that your information is untrue, inaccurate, or incomplete, we have the right to indefinitely suspend or terminate your membership and refuse to provide you with access to the Site.

5. 📦 Orders, Delivery, and Products 

5.1. Product Description and Availability 

Print Afrika makes reasonable efforts to ensure product descriptions are accurate. However, we do not warrant that descriptions or other content of this Site is completely accurate, reliable, or error-free. If a product is materially not as described, your sole remedy is to return it in unused condition as per our Refund & Return Policy.

If an item you have ordered is out of stock, we will endeavor to inform you within 48 hours and provide options for restock time, alternatives, or order cancellation and refund as per our policy.

5.2. Damage Claims or Shortages 

Any claims for damage and/or shortages MUST be reported within 48 hours of receipt. You must check your deliveries upon receipt. By accepting these T&C, you agree to the conditions outlined in our separate Refund & Return Policy.

5.3. Cancellation by Print Afrika 

We reserve the right, at our sole discretion, to refuse or cancel any order for any reason, including:

  • Limitations on quantities available for purchase.

  • Inaccuracies or errors in product or pricing information.

  • Problems identified by our credit and fraud avoidance department.

If your order is cancelled after your payment has been processed, the amount will be reversed back to your original payment method.

5.4. Communication Consent 

You grant permission to Print Afrika to call or SMS you from our telephony provider for clarification needed on design, order status, or delivery-related information. You also accept to receive SMS related to order status updates.

5.5. Delivery Risk and Accuracy 

  • You agree to bear the risk of delay in delivery of goods caused by third-party logistics providers. Print Afrika would not be held responsible for such delays.

  • You confirm that the delivery address provided is correct and proper in all respects. Non-delivery due to a mistake by you (i.e., wrong name or address) shall result in any extra re-delivery cost being claimed from you.

6. 💳 Payment and Fraudulent Transactions

6.1. Payment Card Details 

You agree, understand, and confirm that the payment card details provided by you for services on Print Afrika will be correct and accurate. You must use your own payment card. This information will not be utilized and shared by Print Afrika with any third parties unless required for fraud verifications or by law or court order.

6.2. Liability for Fraud 

Print Afrika will not be liable for any payment card fraud. The liability for the fraudulent use of a card will be on you, and the onus to ‘prove otherwise’ shall be exclusively on you. We are not liable for any loss or damage arising from the decline of authorization for any transaction due to the cardholder exceeding the preset limit.

6.3. Fraudulent/Declined Transactions 

Print Afrika reserves the right to recover the cost of goods, collection charges, and legal fees from persons using the Site fraudulently. We reserve the right to initiate legal proceedings against such persons for fraudulent use of the Site and any other unlawful acts.

7. ⚖️ User Eligibility and Prohibited Use 

7.1. Eligibility 

You represent and warrant that you are competent and eligible to enter into a legally binding agreement under applicable Kenyan laws, rules, and regulations. You shall not use this Site if you are not competent to contract.

7.2. Prohibited Uses 

You may not use the Site for any of the following purposes:

  • Disseminating any unlawful, harassing, libelous, abusive, or otherwise objectionable material.

  • Transmitting material that encourages criminal offense or civil liability.

  • Gaining un-authorised access to other computer systems.

  • Interfering with any other person’s use or enjoyment of the Site.

  • Breaching any applicable laws.

  • Making, transmitting, or storing electronic copies of copyrighted materials without the owner’s permission.

8. 🔒 User Account Data and Erasure 

8.1. Data Protection 

We protect personal information in accordance with our Privacy Policy. We share only the necessary information for order processing with our trusted logistics and business partners.

8.2. Request Erasure of Personal Data (H3)

You have the right to ask us to delete or remove your personal data when there is no good reason for us to continue processing it. In order to exercise this right, you can send an email request to info@printafrika.ke stating the email address used to log into your account.

8.3. Voucher Codes 

Print Afrika reserves the right to limit the use of voucher codes. We may, at our discretion, limit the number of times per customer a coupon code may be used. Voucher codes are generally intended for individual, one-time use per customer.
